In cases where the user includes files containing personal data on shared hosting servers, GenerationFit is not responsible for the user’s non-compliance with the GDPR.

Data retention in accordance with the LSSI:
GenerationFit informs that, as a data hosting service provider and in accordance with the provisions of Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the necessary information to identify the origin of the hosted data and the moment the service began. This data retention does not affect the confidentiality of communications and may only be used in the context of a criminal investigation or for public security purposes, made available to judges and/or courts or the relevant Ministry.

Intellectual Property of the Software:
The user must respect third-party programs provided by GenerationFit, even if they are free and/or publicly available.

The user does not acquire any right or license for the software necessary for the provision of the service, nor for the technical information related to the service, except for the rights and licenses necessary for the fulfillment of the contracted services and only for the duration of these services.

For any action exceeding the performance of the contract, the user will need written authorization from GenerationFit. It is prohibited for the user to access, modify, or view the configuration, structure, and files of GenerationFit’s servers, assuming civil and criminal responsibility for any incidents that may occur in the servers and security systems as a direct result of negligent or malicious actions.

Intellectual Property of Hosted Content:
The use of GenerationFit’s services contrary to intellectual property laws is prohibited, particularly:

The use of services that violate Spanish laws or infringe third-party rights.

The publication or transmission of content that, in GenerationFit’s judgment, is violent, obscene, abusive, illegal, racial, xenophobic, or defamatory.

Cracks, serial numbers, or any other content that violates third-party intellectual property rights.

The collection and/or use of personal data from other users without their express consent or in violation of Regulation (EU) 2016/679 of the European Parliament and Council.

The use of the mail server and email addresses for sending unsolicited bulk mail.
The user is fully responsible for the content of their website, the information transmitted and stored, hyperlinks, third-party claims, and legal actions regarding intellectual property.

Third-Party Rights and Protection of Minors:

The user will indemnify GenerationFit for any expenses arising from the user’s responsibility, including legal defense costs, even in the case of a non-definitive court ruling.

Protection of Hosted Information:
GenerationFit backs up the content stored on its servers; however, it is not responsible for the loss or accidental deletion of data by users. It also does not guarantee full recovery of deleted data, as such data may have been deleted and/or modified since the last backup.
The services offered, except for backup services, do not include the restoration of content preserved in GenerationFit’s backups when this loss is attributable to the user. In this case, a fee will be determined based on the complexity and volume of the recovery, always with the user's prior consent.

Restoring deleted data is only included in the service price when the loss is due to issues attributable to GenerationFit.
​
Commercial Communications:
In accordance with the LSSI, GenerationFit will not send unsolicited advertising or promotional communications via email or other electronic means unless previously requested or expressly authorized by the recipients.

In cases where there is a prior contractual relationship, GenerationFit is authorized to send commercial communications regarding products or services similar to those initially contracted by the client.
​
In any case, the user, after verifying their identity, may request not to receive any more commercial information through the Customer Service channels.
